ORDERS & AGREEMENTS
These terms and conditions apply to all orders and agreements made with Time+Space. By entering into an agreement with Time+Space, the customer accepts these terms. The agreement between the customer and Time+Space is established after Time+Space confirms the order placed by the customer. The customer will receive the order confirmation via email.
DELIVERY TIME
The delivery time for products in stock is a maximum of 2 weeks after receipt of payment. If Time+Space cannot meet the delivery time, this will be communicated to the customer in writing. In that case, the customer can cancel the agreement by notifying us in writing, after which Time+Space will refund the amount already paid. The delivery time for products not in stock is 2–4 weeks. If your order includes both in-stock and out-of-stock items, shipment will wait until the full order is complete.
HOW DO I KNOW IF AN ITEM IS IN STOCK?
If an item is not in stock, we will inform you by email. Delivery usually follows within 2–4 days.
1. DEFINITIONS
In these terms and conditions:
- Cooling-off period: the period within which the consumer may exercise the right of withdrawal;
- Consumer: a natural person not acting in a professional or commercial capacity who enters into a distance agreement with the trader;
- Day: calendar day;
- Ongoing transaction: a distance agreement relating to a series of products and/or services spread over time;
- Durable medium: any device that enables the consumer or trader to store information addressed to them personally in a way that allows future access and unaltered reproduction;
- Right of withdrawal: the consumer’s option to withdraw from the distance contract during the cooling-off period;
- Trader: the natural or legal person offering products and/or services at a distance to consumers;
- Distance contract: a contract where, within a system organized by the trader for distance sales, only distance communication is used up to and including the moment the contract is concluded;
- Distance communication method: a method that can be used to conclude a contract without the consumer and trader being in the same place at the same time.

3. APPLICABILITY
These general terms and conditions apply to every offer from the trader and every distance contract concluded between the trader and the consumer.
4. THE OFFER
- If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
- The offer includes a complete and accurate description of the offered products and/or services. Descriptions are sufficiently detailed for the consumer to assess the offer properly. If the trader uses images, they are truthful representations of the products and/or services. Obvious errors or mistakes do not bind the trader.
- The offer includes clear information about:
- the total price including taxes;
- any delivery costs;
- how the agreement will be formed and the necessary steps;
- whether or not the right of withdrawal applies;
- payment, delivery, and performance terms;
- the deadline for accepting the offer or the period the price is guaranteed;
- communication costs if different from the standard rate;
- whether the contract will be archived and how the consumer can access it;
- how the consumer can verify or correct submitted information;
- any other available languages for the contract;
- applicable codes of conduct and how to consult them;
- the minimum duration in case of ongoing transactions.
5. THE AGREEMENT
- The agreement is formed when the consumer accepts the offer and meets the related conditions.
- If the consumer accepts the offer electronically, the trader will confirm receipt without delay. Until this confirmation is received, the consumer may cancel the contract.
- If the agreement is made electronically, the trader will take appropriate technical and organizational measures to secure the electronic transmission of data and ensure a secure web environment. If the consumer can pay electronically, the trader will implement appropriate security measures.
- The trader may verify the consumer’s ability to meet payment obligations and other relevant facts. If there are good grounds to refuse the contract, the trader may refuse an order or attach special conditions to it.
- Upon delivery, the trader will include the following, in writing or on a durable medium:
- the trader’s address for complaints;
- conditions and procedures for the right of withdrawal, or a clear exclusion statement;
- warranty and after-sales information;
- the info specified in Article 4(3), unless already provided;
- conditions for terminating the contract if longer than one year or indefinite.
- For ongoing transactions, this applies only to the first delivery.
6. RIGHT OF WITHDRAWAL
- The consumer can cancel a purchase without giving reasons within 14 days after receiving the product.
- During the cooling-off period, the consumer must handle the product and packaging with care. They may only unpack or use the product as needed to determine whether they wish to keep it. If exercising the right of withdrawal, the consumer must return the product with all accessories, in original condition and packaging if reasonably possible, following the trader’s instructions.
7. COSTS IN CASE OF WITHDRAWAL
- If the consumer exercises the right of withdrawal, they bear the cost of return shipping.
- If the consumer has already paid, the trader will refund this amount as soon as possible, no later than 30 days after the return or withdrawal.
8. EXCLUSION OF RIGHT OF WITHDRAWAL
- The trader may exclude the right of withdrawal under certain conditions. This must be clearly stated before the contract is concluded.
- Exclusions apply to products:
- made to consumer specifications;
- clearly personal in nature;
- that cannot be returned due to their nature;
- that may spoil or age quickly;
- whose prices fluctuate beyond the trader’s control;
- single newspapers or magazines;
- audio/video recordings or software if unsealed by the consumer.
- Exclusions also apply to services:
- related to accommodation, transport, dining, or leisure for specific dates;
- begun with the consumer’s explicit consent before the withdrawal period ended;
- related to betting or lotteries.
9. PRICE
- During the validity period stated in the offer, prices will not be increased, except due to VAT changes.
- The trader may offer products with variable prices if those are tied to financial market fluctuations beyond the trader’s control.
- Price increases within 3 months of contract formation are only allowed if required by law.
- Price increases after 3 months are allowed only if agreed upon and if the consumer can cancel the contract from the day the increase takes effect.
- All product and service prices include VAT.
10. CONFORMITY & WARRANTY
- The trader guarantees that products and/or services conform to the agreement, specifications, and reasonable standards of usability and reliability, and comply with legal requirements at the time of the contract. If agreed, the trader guarantees suitability beyond normal use.
- Any manufacturer or importer warranty does not limit legal consumer rights.
11. DELIVERY & PERFORMANCE
- The trader will handle product orders and service requests with care.
- Delivery will be made to the address provided by the consumer.
- Orders will be delivered promptly, no later than 30 days unless agreed otherwise. If delivery is delayed or partially fulfilled, the consumer will be informed within one month. They may cancel the agreement without cost.
- In case of cancellation, the trader will refund the consumer within 30 days.
- If delivery is impossible, the trader will offer a replacement item and clearly communicate this. The right of withdrawal remains. Return costs for replacements are the trader’s responsibility.
- The risk of damage or loss remains with the trader until delivery to the consumer, unless otherwise agreed.
12. ONGOING TRANSACTIONS: DURATION, TERMINATION & RENEWAL
Termination
- The consumer may cancel contracts of indefinite duration involving regular deliveries at any time, with a maximum notice period of one month.
- Fixed-term contracts can be terminated at the end of the term with one month’s notice.
- The consumer may cancel:
- at any time;
- in the same way as the contract was entered into;
- with the same notice period as the trader applies.
Renewal
- Fixed-term contracts cannot be automatically renewed.
- Exceptions apply to newspaper/magazine subscriptions, which may be extended by up to three months with a one-month cancellation period.
- Indefinite renewals are only valid if the consumer can cancel at any time with one month’s notice, or three months if deliveries are less frequent than once a month.
- Trial subscriptions automatically end after the trial period.
Duration
- For contracts longer than one year, the consumer may cancel after one year with a maximum one-month notice unless early termination is unreasonable.
13. PAYMENT
- Unless otherwise agreed, payments must be made within 14 days of the cooling-off period start. For services, the term starts after confirmation.
- Advance payments for product sales may not exceed 50%. Consumers have no rights under the contract until payment is received.
- Consumers must promptly report inaccuracies in payment details.
- In case of late payment, the trader may charge reasonable costs communicated in advance, within legal limits.
14. COMPLAINTS PROCEDURE
- The trader has a known complaint procedure and handles complaints accordingly.
- Complaints must be submitted promptly, clearly described, after discovery.
- Complaints will be answered within 14 days. If more time is needed, the consumer will be informed.
- If unresolved, a dispute arises that may be subject to dispute resolution.
15. DISPUTES
Only Dutch law applies to agreements between the trader and the consumer covered by these terms.
16. ADDITIONAL OR DIFFERENT TERMS
Any additional or different terms must not disadvantage the consumer and must be recorded in writing or stored accessibly on a durable medium.
